These Terms and Conditions ("T&Cs") govern your access to and use of our website, including purchases of our Frame Interval Timing (FIT) devices and related services. By accessing or using our website, you agree to be bound by these T&Cs. If you do not agree, please do not use the website.

2. Use of the Website

Permitted Use: Use the website for lawful purposes only. Do not engage in unauthorised access, data scraping, or activities that disrupt the website’s functionality.

3. Products and Services

Frame Interval Timing (FIT) Devices: We manufacture bespoke, made-to-order professional electronic time measurement devices. Product descriptions are accurate to the best of our knowledge, but specifications may vary slightly due to custom requirements.

Calibration Services: Devices are annually calibrated by an ISO17025-accredited test laboratory. Calibration certificates are provided upon request.

Pricing: Prices are in GBP, exclusive of VAT unless stated. For UK customers, fees, taxes, shipping, and goods-in-transit insurance are included in quotations. International customers may incur additional charges for exchange rates, customs, taxes, and carriage. We may adjust prices without notice, except for confirmed orders.

Orders: Orders are subject to availability and acceptance. As devices are made to order, all orders are final upon confirmation and non-cancellable unless agreed in writing. We may refuse orders at our discretion.

You agree to provide accurate billing information. If you cancel a project after work begins, you are responsible for paying for work completed to date.

4. Delivery

Delivery Timeframes: As devices are made to order, delivery typically occurs within 1–2 months after receipt of a purchase order or payment. Delivery times are estimates and may vary.

Carriage and Liability: For UK orders, shipping and goods-in-transit insurance are included in quotations. For international orders, additional carriage and customs costs apply. We cover carriage costs and liability for loss or damage only for shipments we or our ISO17025-accredited test laboratory dispatch to you. You, as the sender, bear all carriage costs and liability for loss or damage for any shipments to us or our test laboratory (e.g., for calibration or warranty claims).

5. Returns and Refunds

No Change-of-Mind Returns: Due to the bespoke, made-to-order nature of FIT devices, we do not offer returns or refunds for change of mind or cancellation after order confirmation.

Faulty Products: If a device is faulty, follow our warranty process (Section 6). Contact us at info@benneman.co.uk for approval before returning. Returns are subject to our Returns Policy.

Return Shipping: You are responsible for all return shipping costs and liability for loss or damage during transit to us or our test laboratory. Products must be unused (except for fault testing) and in original packaging.

6. Warranty

Product Warranty: FIT devices carry a 2-year warranty from the date of delivery, covering defects in materials and workmanship. Contact us at info@benneman.co.uk for claims. The warranty does not cover misuse, unauthorised modifications, or normal wear and tear.

Exclusions: We are not liable for decisions or outcomes based on the accuracy of our devices, despite self-verification and ISO17025-accredited calibration.

Warranty Returns: You bear shipping costs and liability for loss or damage when sending devices to us or our test laboratory for warranty claims. We cover shipping costs for replacement or repaired devices sent back to you.

7. Intellectual Property

All content on this website (e.g., text, images, logos, designs) is owned by or licensed to Benneman Ltd and protected by copyright, trademark, and other laws. You may not reproduce, distribute, or modify any content without our prior written consent.

8. Liability

Limitation: To the fullest extent permitted by law, our liability for any claim arising from your use of the website, products, or services is limited to the amount paid for the relevant product or service.

Exclusions: We are not liable for indirect, consequential, or incidental losses (e.g., loss of profits, data, or use), issues beyond our control (e.g., internet failures, force majeure), or decisions based on device accuracy. We are not liable for loss or damage to products shipped by you to us or our test laboratory.

Statutory Rights: Nothing in these T&Cs excludes our liability for defective products under the Consumer Rights Act 2015 (where applicable) or for death or personal injury caused by our negligence.

9. Privacy and Data Protection

We process your personal data in accordance with our Privacy Policy and the UK GDPR. By using the website, you consent to such processing and warrant that all data provided is accurate.

10. Termination

We may suspend or terminate your access to the website if you breach these T&Cs, without notice or liability. Upon termination, you must cease all use of the website.

11. Governing Law and Jurisdiction

These T&Cs are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
